Terms & Conditions

These Terms & Conditions (“Terms”) govern the use of services provided by Foodealize LLC (“Foodealize,” “we,” “us,” or “our”). By purchasing or using our services, you agree to these Terms.

1. Services

Foodealize provides AI-assisted food photography enhancement and marketing visuals for restaurants and food businesses. Services may include image enhancement, creative variations, and short-form promotional video assets based on materials provided by the client.

All services are provided as creative and marketing services, not as guarantees of business performance.

2. No Guarantee of Results

Foodealize does not guarantee increased sales, revenue, engagement, visibility, or customer acquisition. Results may vary based on factors outside our control, including but not limited to pricing, location, food quality, brand reputation, and marketing strategy.

3. Client Materials & Rights

By submitting images, videos, logos, or other content, you confirm that:

  • You own the content or have the legal right to use it

  • Foodealize may modify, enhance, and adapt the content for service delivery

Foodealize is not responsible for copyright or trademark issues related to client-provided materials.

4. Turnaround Times

Turnaround times are estimates, not guarantees.

  • Most image requests are delivered within 24–48 hours

  • Larger projects or full overhauls may take longer and will be communicated during onboarding

Delays caused by incomplete submissions or client revisions are not the responsibility of Foodealize.

5. Revisions & Scope

Reasonable revisions are included to ensure quality and consistency.
Requests that fall outside the scope of your selected plan or original request may require:

  • A plan upgrade, or

  • An additional fee

Foodealize reserves the right to determine what constitutes reasonable revisions.

6. Payments & Billing

One-Time Services

  • Payment is required in full before work begins

  • Once work has started, payments are non-refundable

Subscriptions

  • Subscriptions are billed automatically according to the selected billing cycle

  • Subscription management, updates, and cancellations are handled through Stripe

7. Cancellations

Subscriptions may be canceled at any time via the Stripe Customer Portal using the link included in your receipt or onboarding email.

  • Cancellations take effect at the end of the current billing period

  • No partial refunds are issued for unused time

8. Refund Policy

Optional Preview & Approval Policy (One-Time Services Only)


For select one-time services, clients may optionally request a preview and approval process prior to final delivery.
 

If this option is selected:
 

  • Foodealize will provide watermarked preview outputs for review

  • The client may approve the work and complete final delivery, or

  • Request a cancellation before final, non-watermarked assets are released


If the client cancels during the preview stage:

  • A full refund will be issued

  • No rights to use the preview assets are granted


Once final, non-watermarked assets are delivered:

  • The service is considered completed

  • The order becomes non-refundable

This preview option must be explicitly requested or agreed to in writing prior to work beginning.

9. Limitation of Liability

Foodealize’s total liability, for any claim arising from our services, is limited to the amount paid by the client for the specific service in question.

Foodealize is not liable for indirect, incidental, or consequential damages, including lost revenue or business opportunities.

10. Modifications

Foodealize may update these Terms at any time. Continued use of services constitutes acceptance of the updated Terms.
